Loyalty Program Rules
Article 1 - Purpose
The purpose of these regulations is to define the terms and conditions of participation in the AN Model Cars loyalty program (hereinafter referred to as "the Program"). The Program allows registered customers to accumulate points for each eligible purchase on the website www.anmodelcars.com and to benefit from specific advantages.
Article 2 - Conditions of membership
2.1. The Program is open to any natural person of legal age who has placed an order on www.anmodelcars.com.
2.2. Membership in the Program is free and automatic from the first order.
2.3. By joining the Program, the customer unreservedly accepts the terms of these regulations.
Article 3 - Operation of the Program
3.1. Accumulation of points : For each purchase made on the website www.anmodelcars.com, the customer accumulates loyalty points according to the following scale: 1 euro spent = 1 loyalty point. The points are credited to the customer's kitty only after the order has been shipped. The points are deducted from the kitty if the order is cancelled or refunded.
3.2. Validity of points : Points are valid for a period of 2 years from the date of acquisition. After this period, unused points will be automatically deleted from the customer account.
3.3. Prize pool and use of points :
- The points accumulated by the customer are stored in a kitty accessible from their customer account.
- The customer can use his points to exchange for gifts, according to a list available in his kitty.
- When a customer selects a gift, they are assigned a unique code. This code must be used on their next order for the gift to be included in the shipment.
- Gifts can only be shipped in combination with a new order placed on the website www.anmodelcars.com.
- Points used to redeem a gift are deducted from the prize pool total at the time of order confirmation.
3.4. Restrictions : Points cannot be exchanged for cash or transferred to another account. Gifts obtained cannot be exchanged or refunded, except in the event of a proven defect.
Article 4 - Benefits of the Program
4.1. Benefits offered under the Program may include, but are not limited to: exclusive discounts, gifts, free shipping, private sales and invitations to special events.
4.2. The benefits of the Program are subject to specific conditions indicated at the time of their proposal and may be modified or withdrawn at any time by AN Model Cars.
Article 5 - Duration and modification of the Program
5.1. The Program is offered for an indefinite period. AN Model Cars reserves the right to terminate the Program at any time, with 30 days’ notice to participants.
5.2. AN Model Cars also reserves the right to modify the terms of the Program at any time. Any changes will be notified to participants by email or via the website www.anmodelcars.com.
Article 6 - Previous orders
10.1. The Loyalty Program takes into account orders placed from August 1, 2023. Purchases made and delivered since this date are eligible for the accumulation of points according to the conditions provided for in these regulations.
10.2. Orders placed before August 1, 2023 are not eligible for loyalty points. Customers will not be able to claim points retroactively for these orders.
Article 7 - Personal data
6.1. The data collected under the Program are processed in accordance with the applicable regulations on the protection of personal data, in particular the General Data Protection Regulation (GDPR).
6.2. Participants have the right to access, rectify, delete, limit and transfer data concerning them. They can exercise these rights by contacting us.
6.3. The data is retained for the duration of membership in the Program and may be deleted at any time at the request of the participant or upon expiry of the legal retention period.
Article 8 - Liability
7.1. AN Model Cars cannot be held responsible for any malfunction, interruption, or other technical problem affecting the Loyalty Program.
7.2. AN Model Cars reserves the right to exclude any participant from the Program in the event of non-compliance with the rules or proven fraud.
Article 9 - Acceptance and interpretation of the regulations
8.1. Participation in the Program implies full and complete acceptance of these rules.
8.2. In the event of a dispute over the interpretation or application of these rules, the participant may contact AN Model Cars customer service. In the absence of an amicable agreement, the dispute will be submitted to the competent courts in France.
Article 10 - Applicable law and competent jurisdiction
These rules are subject to French law. Any dispute relating to the interpretation, validity and consequences of these rules will be submitted to the competent courts within the jurisdiction of the Annecy Court of Appeal.
